SUMMARY:

In a pandemic scenario in Brazil, in the fight to save the greatest number of lives of the Brazilian population, since all lives matter, innovations were implemented in the legislation on public bidding and contracting in order to promote the streamlining of government procurement processes for combating the Covid-19 pandemic. Thus, during the period of the state of public calamity, decreed in February/2020, all public administration bodies in the Municipalities, Federal District, States and Union were able to opt for direct purchases, with no need to bid. That said, public managers carried out their contracts and acquisitions through waiver of bidding, without publication of a bidding notice and without fulfilling its phases. Given the above, one wonders what is the profile of these waivers of public procurement tenders to face COVID-19? As it is a case study, this research chose to investigate the municipality of Sete Lagoas-MG, as this municipality has the Social Observatory (OS) entity, which contributes to the monitoring and inspection of public spending. Thus, the objective of this work is to investigate the profile of waivers of public procurement bidding for the COVID-19 facing the municipality of Sete Lagoas - MG. More specifically, the study aims to: 1) identify the characterization of public purchases made through bidding waivers to face COVID-19 (value, supplier location, soliciting area, among others); 2) verify compliance with the legal requirements of the waivers of public procurement bidding brought by Laws 13.979/2020 and 14.035/2020; 3) find out how public managers justify their decisions regarding waivers of bids; 4) describe the guidelines of the Sete Lagoas Social Observatory (OS-7L) in the process of monitoring exemptions from public procurement in the municipality, with an emphasis on the pandemic period. To carry out this study, qualitative research, exploratory and descriptive character will be adopted. Data will be collected through documents, websites, participant observation, interviews with the coordinator of OS-7L and purchasing manager of the municipality. To organize the data, a Check-list spreadsheet will be prepared and the interviews will be handled through content analysis. The research results will portray the purchasing profile resulting from the decisions of Setelagoan managers in the acquisition and contracting processes of equipment, materials, supplies, services and engineering works in the fight against coronavirus and if the justifications described for purchasing decision-making without bidding are in line with legal provisions. In addition to identifying whether the minimum requirements of Law No. 13.979/2020 are being met, it will be possible to find out about the objects purchased, whether the suppliers are from the locality, and about the nature of the suppliers, among other aspects that can contribute to understanding the actions and decisions of public managers at this atypical moment. The aim of this study is also to contribute to society in general; as it is a theme linked to municipal management, which is the public sphere of power closest to the citizens. In addition, expenditures against Covid-19 are substantial, and it is the right of local society to know the profile of public purchases exempted from bidding and even to contribute, through entities such as the Social Observatory, to the decisions of public managers.
