SUMMARY:

This research aims to understand to what extent disrespect for the right to disconnect in telework can configure a hypothesis of moral harassment. To this end, we propose an analysis of the main major themes that permeate the subject, namely, moral harassment, teleworking and the right to disconnect. This analysis will be done by bringing the main existing studies on the subject, passing through its concepts, historical evolution and the most relevant discussions about each of them. The purpose of understanding the state of the art of moral harassment in the current times, in which we live in an increasingly suppressive neoliberalism of workers' rights, is to allow us to have tools to analyze the positioning of the judiciary in the face of situations of disrespect for the right to disconnection. We will use the case study of a labor lawsuit whose main claim is compensation for disrespecting the right to disconnection, in order to discuss the possibility of framing or not the situation as a hypothesis of moral harassment. With this investigation, we intend to contribute to the advancement of discussions about the new forms of moral harassment resulting from changes in labor relations in the neoliberal system and to provide organizations with auxiliary tools in the decision-making process and theoretical and legal basis for effective action in the prevention of these new forms of harassment.
